The criteria for bringing a claim and who may make such a claim are set out in the Inheritance (Provision for Family and Dependants) Act 1975 and there are strict time limits imposed as to when a claim can be made and it is usually six months from the date probate and/or letters of administration are granted.

Spousal or Civil Partner Claims
Claims can be made when a spouse or civil partner is entitled to receive maintenance for living expenses, a home or a share of an estate, a compensation for loss of income or if they relied on their partner financially.
