Reasons For Estate Dispute Claims
Estate disputes can arise when there are disagreements over the ownership, distribution or management of the estate of a deceased person. Disputes commonly happen between beneficiaries and Executors but also between Executors. Here are some reasons why claims are brought:
Property Ownership
If the property was owned jointly or individuals state the property belonged to them, conflicts may arise. There may be issues as to who owned any property in the Estate and the way in which it was legally held by the deceased. If the property was jointly owned as ‘tenants in common’, the share is split evenly. If the property was owned as joint tenants, the surviving owner would usually inherit the property. Additionally, if the deceased held the property in trust for another person, there may be disputes about who owns the property.

When there are multiple individuals who have inherited the property, or perhaps residual Estate there may be conflict as to whether they should sell, rent or keep the property.

Someone who was not named in the Will may wish to make a Claim over the Estate or it may be that the leased owed money to a third party. This may then lead on to the third party either challenging the Will or making a claim against the Estate.

If the estate has been handled by the executor incorrectly or there has been dishonesty by an Executor or perhaps someone with the benefit of a Lasting Power of Attorney then this may give rise to a claim. Disputes could occur if someone named in the Will thinks the Executor or Trustee (if there is a Trust) appointed to administer or manage the Estate is not dealing with the property in the correct way.
