Frequently Asked Questions
Professional Negligence claims against a barrister occur when a barrister fails to provide a service to the standard expected of them which results in harm or loss to the client.
To prove a Professional Negligence claim in tort against a barrister, you must be able to show:
- The barrister owed you a duty of care.
- They have breached their duties through being negligent.
- The breach caused you financial loss or harm.
If you believe your barrister has given you bad advice or has failed to properly prepare for a court hearing or badly prepared documents and you have suffered loss, then it is possible that you may have a claim against your barrister.
To see if you have a potential claim, get in touch and we can assess the merits of your claim.
Typically, you have six years from the date of when the negligence occurred. Although, this can in some cases be extended by three years if the negligence is not immediately discovered.
If you have already filed a complaint with the Bar Standards Boards or Legal Ombudsman, you can still make a claim. A Professional Negligence claim will seek compensation for the losses suffered, whereas the Bar Standards Board/Legal Ombudsman addresses disciplinary matters. They serve different purposes. However, you should seek legal advice before accepting any offer of settlement as this can affect your ability to make a claim for Professional Negligence.
